1. Agreement to Terms

By registering for or using JobSea ("the Service", "we", "us", "our") at jobsea.co.za, you ("the User", "you") agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service. These terms constitute a legally binding agreement between you and JobSea.

2. Description of Service

JobSea is an automated job application service. We search publicly available job listings on your behalf and send personalised application emails to prospective employers using information you provide in your profile. JobSea does not guarantee employment, interviews, responses from employers, or any specific outcome from the applications we send.

3. Eligibility

You must be at least 18 years of age and legally entitled to work in South Africa to use this Service. By registering, you confirm that the information you provide is accurate, truthful, and your own. You may not create an account on behalf of another person without their explicit consent.

4. Subscription and Billing

  • The Service is offered on a subscription basis.
  • The service includes a 7-day free trial, followed by R69 per month thereafter.
  • Billing is handled securely through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis.
  • Prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.
  • We reserve the right to change pricing with 30 days' written notice to your registered email address.
  • Failed payments may result in suspension of your account until payment is received.

5. Cancellation and Refunds

  • You may cancel your subscription at any time from the Billing page in your account.
  • Cancellation takes effect at the end of the current billing period. You will continue to have access to the Service until then.
  • We do not offer refunds for partial months or periods already paid for, except where required by South African consumer protection law.
  • If you believe you have been incorrectly charged, contact us within 14 days at support@jobsea.co.za and we will investigate.

6. Your Responsibilities

By using the Service, you agree to:

  • Provide accurate and truthful information in your profile, CV, and job preferences.
  • Ensure your CV and profile do not contain false qualifications, fabricated experience, or misleading information. You are solely responsible for the accuracy of your application materials.
  • Not use the Service to apply for jobs you are not legally permitted to hold.
  • Keep your account credentials confidential and not share your account with others.
  • Promptly update your profile if your details change.
  • Respond to employer communications professionally and in a timely manner — we send the application, but you are responsible for all follow-up.

7. No Employment Guarantee

JobSea provides an application submission service only. We make no representation, warranty, or guarantee that:

  • Any application will result in an interview or job offer
  • Employers will open, read, or respond to applications we send
  • The jobs we apply to will still be available or accurately described
  • The Service is suitable for your specific circumstances or career goals

Employment outcomes depend entirely on factors outside our control, including employer preferences, market conditions, and your qualifications.

8. Intellectual Property

You retain ownership of all personal information, CV content, and materials you upload. By submitting this content, you grant JobSea a limited, non-exclusive licence to use it solely for the purpose of delivering the Service (generating cover letters, sending applications, and producing reports).

All other content, branding, code, and design of the JobSea platform is the intellectual property of JobSea and may not be copied, reproduced, or distributed without written permission.

9. Limitation of Liability

To the maximum extent permitted by South African law:

  • JobSea is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any loss of employment opportunity, income, or damages arising from use of or inability to use the Service.
  • Our total liability to you for any claim arising under these terms is limited to the amount you paid us in the 30 days preceding the claim.
  • We are not responsible for the actions, decisions, or conduct of employers who receive applications through our Service.

10. Acceptable Use

You may not use the Service to:

  • Submit false, fraudulent, or misleading applications
  • Harass, spam, or abuse employers or third parties
  • Attempt to reverse-engineer or interfere with the platform
  • Violate any applicable South African law or regulation

Breach of this clause may result in immediate termination of your account without refund.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you breach these Terms, provide false information, or engage in conduct we deem harmful to the Service or third parties. You may also close your account at any time by contacting support@jobsea.co.za.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts. The Consumer Protection Act, 68 of 2008 and the Electronic Communications and Transactions Act, 25 of 2002 apply where relevant.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email with at least 14 days' notice. Continued use of the Service after that period constitutes acceptance of the updated terms.
